Community Wins Lawsuit
StopRocketShip.com has just learned that the Washington/Tamien community has won a lawsuit against Rocketship and the Santa Clara County Office of Education in a tentative ruling!!!
IMPORTANT NOTE *** This is preliminary ruling subject to a 20 day review. This is NOT a final ruling. However, it is a significant milestone in our community’s struggle against the Rocketship Tamien plan.
The Washington community, in partnership with San Jose Unified School District, filed suit against the Rocketship Tamien plan in March of 2013. You can read about the case in San Jose Unified’s press release:
The case was heard by the honorable Judge Bondonno in the Santa Clara County Superior court on August 7 and 8th, 2013.
On October 7th, 2013, Judge Bondonno ruled that the Santa Clara County Office of Education had overstepped their bounds in granting a zoning exemption to Rocketship for the Tamien site.
But we’re not done yet. Rocketship has side-stepped the Santa Clara County Office of Education, and is not attempting to amend the San Jose General plan, rezoning parklands to light industrial.
